Reauthorization of SUNY Flex (Education Law §355.6)
- Non-construction related services contracts with a value of $250,000 and above for campuses that have been certified by OSC to have adequate procurement controls in place, shall be subject to OAG and OSC approval.
- Non-construction related services contracts for campuses that have not been certified by OSC shall be $75,000 and above for a hospital and $50,000 and above for a non-hospital.
Vendor Debriefing State Finance Law §163(9)(c)
- It is required that all unsuccessful bidders that responded to the solicitation must be provided with written notice of their unsuccessful bids.
- Upon being notified of their unsuccessful bids, Bidders may request a debriefing within 15 calendar days of such notice. The 15 day period starts once unsuccessful bidders are notified.
Restricted Period in Procurement Lobbying (State Finance Law §139-j (f) (d)
- The time of the "restricted period" under procurement lobbying for eligible SUNY procurement in excess of $15,000 has been clarified to commence from its earliest posting:
- on a governmental entity's website;
- in a newspaper of general circulation; or in the NYSCR, of a written notice, advertisement or solicitation of a RFP, IFB, or solicitation of proposals,
- or any other method of solicitation provided by law or regulation soliciting a response from offerers intending to result in a procurement contract with a governmental entity.
Increase in Revenue Contracts Threshold (State Finance Law §112 (3))*
- The monetary threshold for OAG and OSC approval of revenue contracts has been revised from contracting exceeding $10,000 to exceeding $25,000.
