The State University of New York Reauthorization of the Higher Education Act HEA Overview ? HEA passed both houses of Congress on July 31st, 2008. (a mere 5 years later than the statutory deadline) ? Over 1,150 pages long ? Over 150 new reporting requirements ? 64 new programs only a fraction will be funded ? Effective date August 14th, 2008 unless otherwise noted. Several provisions need to go through negotiated rulemaking to clear up ambiguities. ? Most student aid provision are effective July 1st, 2010. ? July 1, 2011 lists are available to the public ? 9 institutional categories of top 5% of institutions ? Highest tuition and fees ? Highest net price ? Largest % increase in tuition and fees ? Largest % increase in net price ? "Net Price definition"- Net price is determined by subtracting need based aid provided per aided student from the cost of attendance. "average yearly price actually charged to a first-time full-time undergraduate student receiving student aid...after deducting such aid." ? State higher education spending ? "MOE" College Costs- Cont. Dept of Ed College Navigator website ? Dept of Ed will have available on the college navigator site: ? post 27 categories of "consumer information" about each institution that participates in title IV. ? a "net price calculator" that will provide any potential student a more personalized estimate. Institutions must post (or create their own and post) on each their website within 2 years of the bill's enactment. ? A "Multi-year tuition calculator" that will estimate future years of tuition at an institution based on the institutions previous tuition increases. ? It will also show "other institution's increases". ? A disclaimer that these are non-binding and subject to change will be posted as well. Student Financial Aid - Preferred Lender Agreements ? FFELP Institutions- must make certain disclosures regarding FFELP loans such as: ? their obligation to process FFELP loans irrespective of who the student chooses as a lender. ? FFELP Dept of Ed- The department is determining what the minimum disclosures should be for FFELP loans offered under the preferred lender agreements and will develop a model form that each institution participating in FFELP will have to use for such disclosures. ? FFELP Lenders- The act also requires that lenders make certain disclosures regarding loan terms and conditions to borrowers at specific times, including prior to disbursement. ? DL Dept of Ed: The department will provide DL institutions a model disclosure form that must: ? be provided to every potential borrower ? institutions must also provide information concurrently with any private loan information that they offer. Student Aid Disclosures cont. ? Guaranty Agencies- (FFEL lenders) are limited with this act in what they can provide (gifts, materials, meals) to institutions, lenders, or their employees. They must also work with institutions to distribute financial literacy materials to students and families. ? Private Lender Provisions ? Prohibited conduct- gifts, revenue-sharing, co-branding ? Preferred lender arrangements re: private loans ? Disclosures to borrowers ? Self-certification Textbooks ? Effective July 1, 2010 ? Institutions must provide: ? ISBN numbers in every course catalog ? Every required and recommended and any additional supplemental materials ? Retail price information must also be included. ? "To be determined" permissible if needed. ? Publishers are required to provide faculty with all pertinent information: ? price ? copyright date of 3 previous editions ? list any substantial revisions from one edition to the next ? textbook alternate format options with pricing ? bundled vs. unbundled formats Peer to Peer File Sharing ? Institutions have annual disclosure requirements to students that: ? 1) states that sharing copyrighted material on a P2P file-sharing program makes them subject to civil and criminal penalties. ? 2) states the civil and criminal penalties for sharing copyrighted materials through a p2p network ? 3) provides the institutions policies on p2p file-sharing. ? Institutions must develop a plan to stop student distribution of copyrighted materials on their network, and that plan institutions must consider technology based deterrents. ? Technology-based deterrents include: bandwidth shaping" and "traffic monitoring". ? Institutions, must also offer to the "extent practicable" alternatives to illegal downloading. Alumni Reporting Requirements ? Requires institutions to report to the Department of Education information on: ? employment placement of graduates ? types of employment obtained by their graduates ? graduates that enroll in graduate or professional education programs ? Information may be gathered from such sources as: ? alumni surveys, ? student satisfaction surveys ? other relevant sources Graduation Rates ? Requires institutions to disaggregate data on the following completion and graduation rates based on: ? student gender, ? race/ethnicity ? receipt of a Pell Grant, ? receipt of specific federal loans but not a Pell Grant ? non-receipt of a Pell Grant nor other specific federal loans (except when the disclosure of data would not yield statistically reliable information or would reveal personally identifiable information). ? Community college outlook- seeking improvements in Neg-Reg... Campus Emergency Response ? Requires institutions to disclose "a statement of current campus policies regarding immediate emergency response and evacuation procedures, including the use of electronic and cellular communication (if appropriate), which policies shall include procedures to- ? (i) immediately notify the campus community upon the confirmation of a significant emergency or dangerous situation involving an immediate threat to the health or safety of students or staff occurring on the campus, unless issuing a notification will compromise efforts to contain the emergency; ? (ii) publicize emergency response and evacuation procedures on an annual basis in a manner designed to reach students and staff; and ?
