Commissioners and Senior Officials

Commissioners and other senior officials (as determined by Executive Law Section 169) holding positions in the Executive Branch may choose one of two methods when requesting reimbursement for travel. One method is a fixed per diem method not supported by receipts. The amounts are set by the State Finance Law, Section 109 (5). The second method is to be reimbursed at the rates allowed for Management/Confidential (M/C) employees as detailed in the specific sections of this manual. Officials may not combine methods for the same trip.

Per Diem Allowance-Overnight Travel
This per diem allowance covers reimbursement for meals, lodging and incidentals $100 per day - The following locations in New York State; New York City, the counties of Erie, Monroe, Nassau, Suffolk, Westchester, or for travel out of State $75 per day - All other locations in New York State

Per Diem Allowance Non-Overnight Travel
When an official is in travel status for less than a full day with no overnight stay, a $25 per diem will be allowed to cover meals and incidental expenses. When lodging is provided free of charge by a State or governmental agency, the official is only eligible for the $25 per diem allowance.
