Zimpher, Chancellor SUBJECT: Abandonment of Real Property – SUNY Empire State College Action Requested The proposed resolution authorizes the abandonment of certain property of the Empire State College. Resolution I recommend that the Board of Trustees adopt the following resolution: Whereas the State University Board of Trustees has determined that the property described hereinafter, located at in the Town of Brighton, New York is no longer necessary or useful to the purposes of the State University; now, therefore, be it Resolved that the Chancellor, or designee, be, and hereby is, authorized to declare abandoned the property, located on Clinton Avenue South, County Route 100 in the Town of Brighton, Monroe County, containing in total an area not to exceed approximately 11.20 acres of land, the approximate location of which is indicated in the attached map; and, be it further Resolved that the Chancellor, or designee, be, and hereby is, authorized to take all steps necessary to execute or approve, in the name of and on behalf of this Board, all documents, notices, maps, or any other instruments necessary or proper in order that such land may be conveyed by the Office of General Services by sale, in accordance with Sections 30-a(1) and 33 of the Public Lands Law. Background The resolution authorizes the abandonment of not more than approximately 11.20 acres of land located on Clinton Avenue South, County Route 100 in the Town of Brighton, County of Monroe, New York. The land was acquired by Empire State College in March 2010 for $855,000 as the future location of ESC’s Genesee Valley Regional Center. The Town of Brighton is concerned about the fiscal impact of the purchase of taxable land by New York State and was instrumental in identifying an alternative location on State-owned land situated about two miles from the subject parcel. Accordingly, the land is no longer needed. Once the real property is declared abandoned by the State University pursuant to the provisions of Public Lands Law §30-a, the State’s Office of General Services is authorized to sell such land at public auction or by sealed bids, per Public Lands Law §33. It is expected that SUNY will receive the sale proceeds. Attachment
