M E M O R A N D U M May 10, 2011 To: Members of the Board of Trustees From: Nancy L. Zimpher, Chancellor Subject: Conveyance of Permanent Easement - State University of New York at Stony Brook Action Requested The proposed resolution authorizes the State University to request the Commissioner of General Services to expand a utility easement of the Suffolk County Water Authority over lands at the State University of New York at Stony Brook Southampton campus. Resolution I recommend that the Board of Trustees adopt the following resolution: Whereas the Suffolk County Water Authority (the “SCWA”) has an easement over certain land at the Stony Brook Southampton Campus that was granted by a previous owner of the Southampton Campus; and Whereas the SCWA has requested that additional acreage be added to such easement so as to build an additional well; and Whereas such additional well shall benefit the surrounding community and may assist in future activities at the Southampton Campus; and Whereas the State University of New York at Stony Brook requests the SUNY Board of Trustees to authorize the inclusion of additional acreage to such preexisting easement (the approximate location of which is indicated on the attachment hereto); and Whereas the Commissioner of General Services is authorized and empowered to convey easements in the lands of The People of the State of New York; now, therefore, be it Resolved that the Chancellor, or designee, be and hereby is authorized to take all steps necessary to execute or approve, in the name of and on behalf of this Board, all documents, notices, maps, or any other instruments necessary or proper to include such additional acreage under the pre-existing easement pursuant to Section 3(2) of the Public Lands Law, subject to approval of the Commissioner of General Services. Background The resolution authorizes the Chancellor, or designee, to request that the Office of General Services increase the acreage of a pre-existing easement in favor of the Suffolk County Water Authority at the Southampton campus. The State University of New York at Stony Brook owns and operates the Stony Brook Southampton Campus. This will increase the acreage of a preexisting easement in favor of the Suffolk County Water Authority at the Southampton campus. Attachment Board Resolution -2- May 10, 2011
