Zimpher, Chancellor Subject: Delegation with Respect to the Purchase of Real Property Action Requested The proposed resolution delegates to the Chancellor, or designee, authority to purchase real property for the State University for a sum not to exceed $1 million, as established by appraisal. Resolution I recommend that the Board of Trustees adopt the following resolution: Whereas Education Law §355(2)(a) authorizes the State University Board to purchase real property for any educational or other purpose within the jurisdiction and corporate purposes of the State University; and Whereas from time to time the State University has adopted resolutions that authorize the purchase of real property at a maximum amount as established by appraisal and that authorize the Chancellor, or designee, to take all steps necessary to execute and approve documents, notices, maps and other instruments necessary or appropriate to effect the acquisition of title to and possession of such property; now, therefore, be it Resolved that the Board of Trustees delegates to the Chancellor, or designee, authority to purchase real property for the State University, for the purposes set forth in Education Law §355(2)(a), for a sum not to exceed $1 million, as established by appraisal, and to take all steps necessary to execute or approve, all documents, notices, maps, or other instruments necessary or proper to effect the acquisition of title to and possession of such property; and, be it further Resolved that the Board of Trustees, on its own initiative, may take up any matter delegated by this resolution. Background The resolution delegates to the Chancellor, or designee, authority to purchase real property for the State University for a sum not to exceed $1 million, as established by appraisal, and to execute and approve any documents necessary to effect acquisition of title to and possession of such property. The purpose of the resolution is to delegate this activity from the Board to the Chancellor, or designee. The State University Board, by Res. 2009-086, adopted June 16, 2009, has authorized the Chancellor, or designee, to accept gifts of real property on behalf of the State University.
