Zimpher, Chancellor Subject: Amendment to Tuition Schedule Action Requested This resolution begins the formal rule-making process to revise the University’s tuition schedule for 2012-13. These rates will become effective with the Fall 2012 semester. Resolution I recommend that the Board of Trustees adopt the following resolution: Whereas the NY-SUNY 2020 Challenge Grant Program Act (“the Act”), Chapter 260, Laws of 2011, authorizes the Board of Trustees to increase resident undergraduate tuition by an amount not to exceed $300 each year for a five year period; and Whereas the NY-SUNY 2020 Challenge Grant Program Act authorizes the Board of Trustees to increase non-resident undergraduate tuition for students enrolled at each of the University centers by up to 10% subject to the approval by the Governor and the Chancellor of a long-term economic and academic plan submitted by each University Center; and Whereas in accordance with the Act, academic plans for the University at Buffalo and Stony Brook University have been approved and the plans for the University at Albany and Binghamton University have been submitted for approval; and Whereas analysis of the tuition schedule, appropriate comparisons to similarly situated institutions, and review of market conditions demonstrates that the resident graduate tuition should be increased by 5.6%, the non-resident graduate tuition rate should be increased 10%, the resident undergraduate tuition rate should be increased by $300 for the 2012-2013 academic year, amounting to a 5.7% increase, and non-resident undergraduate tuition should be increased by 3.5% for students enrolled at the other research/doctoral Institutions, the University Colleges, and the Colleges of Technology; and Whereas tuition rates for certain graduate and professional degree programs are in the third year of a five-year plan calling for increases in all categories; and Whereas the tuition rates brought forth for approval form the basis of the campus revenue projections included in the 2012-13 Financial Plan, which will be presented to this Board for approval; and Whereas adoption on an immediate basis of these tuition increases effective for the Fall 2012 semester is necessary in order for the State University to timely obtain necessary revenue while maintaining program quality and access and to give appropriate notice of the increases to students, their families and financial aid providers; now, therefore, be it Resolved that the Chancellor, or designee, be, and hereby is, authorized and directed to prepare, in accordance with the provisions of the State Administrative Procedure Act, a Notice of Emergency Adoption and Proposed Rulemaking with respect to amendments to section 302.1(2)(b) of Title 8 of the Official Compilation of Codes, Rules and Regulations of the State of New York, to read as follows (brackets denote old material to be deleted; underlining denotes new material to be added): Section 302.1. This reduced rate does not apply to those students enrolled in degree-granting programs leading to a baccalaureate degree. 3 In accordance with Chapter 309 of the Laws of 1996, and enabling action by the Board of Trustees, the Colleges of Technology at Alfred, Canton, Cobleskill, Delhi and Morrisville are authorized to charge this lower rate for special students (part-time) enrolled in degree-granting programs leading to an associate degree or in non-degree granting programs, and taking classes at off-campus locations or during the summer or winter intercessions. This reduced rate does not apply to those students enrolled in degree-granting programs leading to a baccalaureate degree. 4 In accordance with the NY-SUNY 2020 Challenge Grant Program Act, the University Centers at [Albany, Binghamton,] Buffalo and Stony Brook are authorized to charge this rate for non-resident undergraduate students, since their plans were approved for 2011-12. 5 In accordance with the NY-SUNY 2020 Challenge Grant Program Act, the University Centers at Albany and Binghamton are authorized to charge this rate for non-resident undergraduate students, pending approval of their submitted plans. [5]6 As authorized by the Board of Trustees (2010-081), Maritime College is authorized to charge up to this rate for non-resident students from states considered to be in-region (Alabama, Connecticut, Delaware, Florida, Georgia, Louisiana, Mississippi, Maryland, New Jersey, North Carolina, Pennsylvania, Rhode Island, South Carolina, Virginia, and Washington D.C.). Background This resolution authorizes emergency and proposed rulemaking to change the tuition and fee schedule of the State University of New York effective for the Fall 2012 semester. Increases in resident undergraduate tuition rates for students at all the State-operated campuses and non-resident undergraduate rates for students at the University Centers have been authorized through the enactment of the NY-SUNY 2020 Challenge Grant Program Act by the New York State Legislature in 2011 which authorized a Rational Tuition five year plan. Rates for certain graduate and professional programs are being increased in accordance with the third year of a five year plan submitted by the campuses. * As authorized by the NY-SUNY 2020 Challenge Grant Program Act, resident undergraduate tuition will increase by $300 for all students, and pursuant to approval by the Governor and Chancellor of a long-term economic and academic plan submitted by each University Center, non-resident undergraduate tuition for students at the University Centers will increase by 10%. Approval has been obtained for University at Buffalo and Stony Brook University. Plans have been submitted for approval by University at Albany and Binghamton University. The University at Buffalo and Stony Brook are in the second year of their plans, while Albany and Binghamton will be in the first year. * Non-resident tuition for students at the Comprehensive Colleges, Colleges of Technology, and the other Research/Doctoral institutions will be increased by 3.5% * For graduate students enrolled in masters’ and doctoral programs not otherwise specified, resident tuition will be increased by 5.6% and non-resident tuition will be increased by 10% * Tuition rates for professional programs (dental, law, pharmacy, doctorate of physical therapy, doctorate of nursing practice) will be increased by 9% for resident students and by 10% for non-resident students * Tuition rates for the professional program in medicine will be increased by 9% for resident students and by 1.9% for non-resident students * For students enrolled in the MBA program, rates for resident students will be increased 9.1% and by 10% for non-resident students * For students enrolled in the Masters of Architecture program, rates for resident students will be increased by 9% and by 10% for non-resident students * For students enrolled in the Masters of Social Work program rates for resident students will be increased by 9% and by 10% for non-resident students * For students enrolled in the Physician Assistant (Masters) program, rates will be increased by 9% for resident students and by 10% for non-resident students * For students enrolled in the Optometry program, rates for resident and non-resident students will increase by 7%. Even with the recommended increases, the tuition charged at the State-operated campuses of State University of New York is still competitive when compared to peer institutions in other university systems. Accordingly, the tuition increases on an annual basis proposed by this resolution are as follows: Undergraduate Degree: Tuition would increase by $300 to $5,570 for resident students. Tuition would increase by $1,470 to $16,190 for out-of-state students at the University Centers at Buffalo and Stony Brook; by $1,340 to $14,720 at the University Centers at Albany and Binghamton; and, by $500 to $14,820 for all other campuses. Graduate Degree Programs: Tuition would increase by $500 for resident students, to $9,370. Tuition would increase by $1,520 for out-of-state students, to $16,680. For students enrolled in programs leading to a Masters in Business Administration degree, tuition would increase by $920 to $11,130 for residents and by $1,670 to $18,320 for out-of-state students. For students enrolled in programs leading to a Masters in Architecture degree, tuition would increase by $830 to $10,040 for residents and by $1,520 to $16,680 for out-of-state students. For students enrolled in programs leading to a Masters in Social Work degree, tuition would increase by $830 to $10,000 for residents and by $1,520 to $16,680 for out-of-state students. Medicine: Tuition would increase by $2,440 to $29,530 for residents and by $1,000 to $54,650 for out-of-state residents. Law: The tuition at the Law School of the University at Buffalo would be increased by $1,710 to $20,730 for residents and by $3,200 to $35,220 for out-of-state residents. Pharmacy: The tuition at the School of Pharmacy at the University at Buffalo would increase by $1,780 to $21,530 for residents and by $3,800 to $41,750 for out-of-state residents. Physical Therapy and Doctor of Nursing Practice: Tuition for the Doctor of Physical Therapy and Nursing Practice at the University at Buffalo and the University at Stony Brook would increase by $1,480 to $17,940 for residents and by $2,930 to $32,220 for out-of-state residents. Dentistry: Tuition for the D.D.S programs at the Universities at Stony Brook and Buffalo would increase by $2,100 to $25,450 for residents and by $5,200 to $57,230 for out-of-state residents. Optometry: Tuition for the Optometry program at the College of Optometry would increase by $1,300 to $19,900 for residents and by $2,500 to $38,210 for out-of-state residents. Physician Assistant: Tuition for the Physicians’ Assistant graduate program at Stony Brook and Upstate would increase by $820 to $9,940 for residents and by $1,650 to $18,190 for out-of-state residents. The tuition rates were last increased in the Fall 2011. This action will initiate the rulemaking process in accordance with the State Administrative Procedure Act, required since the tuition schedule is contained in regulation. Final adoption of the new rates will occur after a 45 day public comment period in the NY State Register and the adoption by the Board of a resolution authorizing final rulemaking.
