Zimpher, Chancellor Subject: Transfer of Jurisdiction of the Groveland Farmland State University College of Technology at Alfred Action Requested The proposed resolution authorizes the State University to accept the transfer of jurisdiction of real property from the Department of Correctional Services to the State University for the benefit of the College of Technology at Alfred. Resolution I recommend that the Board of Trustees adopt the following resolution: Whereas the Department of Correctional Services (“DOCS”) has within its jurisdiction approximately three hundred acres of farmland with improvements thereon, located in the Towns of Groveland and Mount Morris, Livingston County, New York (“the Groveland Farmland”); and Whereas the Groveland Farmland contain facilities which the State University College of Technology at Alfred can utilize as part of its educational mission; and Whereas the State University has taken temporary possession of the Groveland Farmland under a permit from DOCS in order to carry out certain educational and agricultural programs; and Whereas DOCS has already requested the Commissioner of General Services to transfer jurisdiction of the Groveland Farmland to the State University for use by the State University College of Technology at Alfred; now, therefore, be it Resolved that it is necessary for the educational purposes of the State University College of Technology at Alfred for the State University to assume jurisdiction over the Groveland Farmland, comprising approximately 300 acres owned by The People of the State of New York and situate in the Towns of Groveland and Mount Morris, Livingston County, New York (and as specifically identified on a survey map on file with the Secretary’s Office); and, be it further Resolved that the State University assume jurisdiction, with the approval of the Commissioner of General Services, over the aforementioned Groveland Farmland situate in the Towns of Groveland and Mount Morris, Livingston County, New York; and, be it further Resolved that the Chancellor, or designee, be, and hereby is, authorized to execute any and all documents, notices, maps, or any other instruments necessary or appropriate to effect the assumption of jurisdiction over and possession of such property, including making a request to the Commissioner of General Services for a transfer of jurisdiction to the State University. Background The Groveland Farmland is an approximately 300 acre parcel formerly used by DOCS at its Craig Development Center in Livingston County. DOCS has no further need for the property and has requested the Office of General Services (“OGS”) to transfer jurisdiction to SUNY. Alfred State desires to use it for educational purposes for its agricultural business and agricultural technology programs. Alfred State has been using the property since last year under a permit from DOCS in order to maintain the soil and to carry out educational program activates related to sustainable agriculture activities. Pursuant to Public Lands Law §3(4), a request must also be made by SUNY to the OGS to transfer jurisdiction over the property from DOCS to SUNY.
