Zimpher, Chancellor SUBJECT: Acquisition of Real Property – Cayuga Community College Action Requested The proposed resolution approves the site and value of real property to be conveyed by Cayuga County to Cayuga Community College. Resolution I recommend that the Board of Trustees adopt the following resolution: Whereas Education Law §6306(4) provides that a community college may acquire real property suitable for carrying out the program and purposes of the college; and Whereas regulations of the State University, set forth in 8 NYCRR §603.5(a), provide that real property may be acquired for community college facilities by gift only after the State University Board has approved the selection of the site; and Whereas Education Law §6304(1)(c) provides that a local sponsor may provide all or a portion of its share of capital costs of a project with property, the value of which, for the purpose of determining the amount of State aid for the project, shall be determined by the State University Board, with the approval of the Director of the Budget; and Whereas Cayuga Community College seeks to acquire property from Cayuga County without compensation to construct a performing arts center for the college and seeks a determination by the State University Board that the value of such real property for purposes of Education Law §6304(1)(c) is $135,000, as established by appraisal; and Whereas the subject real property is a vacant lot, consisting of approximately 7,306.8 sq. ft., located at 1-7 State Street, City of Auburn, Cayuga County, New York (the “Site); now, therefore, be it Resolved that the Site be, and hereby is, approved; and, be it further Resolved that the value of the Site for purposes of Education Law §6306(4) is determined to be $135,000; and, be it further Resolved that the Chancellor, or designee, be, and hereby is, authorized to transmit such determination as to the value of such real property to the State Director of the Budget. Background Cayuga Community College seeks to construct a performing arts center to address several needs in the College’s theatre and music programs. The performing arts center will provide a state-of-the-art performance space with enhanced technical training capacity during the academic year. It will create expanded training and placement opportunities for students, faculty and staff during the summer through a partnership with the local regional professional theatre and its summer theatre festival. The downtown location will increase the college’s engagement with the local community. Cayuga County will convey the site to the College without compensation. Regulations of the State University (8 NYCRR §603.5(a)) provide that real property may be acquired for community college facilities by gift only after the State University Board has approved the selection of the site. As authorized by Education Law §6304(c), the College may provide a portion of its one-half share of project costs based upon the value of the site, established by appraisal at $135,000. Education Law §6304(c) provides that the value of a gift of property for the purpose of determining capital cost of a community college project shall be determined by the State University Board, with the approval of the Director of the NYS Division of the Budget.
