Zimpher, Chancellor Subject: Acquisition of Property - State University of New York College at Cortland Action Requested The proposed resolution authorizes SUNY Cortland to acquire real property from the Cortland Auxiliary Services Corporation. Resolution I recommend that the Board of Trustees adopt the following resolution: Whereas it is necessary for the purposes of the State University of New York College at Cortland to acquire real property hereinafter described; now, therefore, be it Resolved that the real property situated at 29 Broadway Ave., Cortland, New York (a legal description of which is attached hereto), be purchased for a sum not to exceed $120,325 as established by a proper appraisal, and an accurate survey and approval of title to said real property by the Attorney General; and, be it further Resolved that the Chancellor, or designee, be, and hereby is, authorized to execute any and all documents, notices, maps, or any other instruments necessary or appropriate to effect the acquisition of title to and possession of such property. Background The resolution authorizes the purchase on behalf of the State University of New York College at Cortland from the Cortland Auxiliary Services Corporation of approximate .27 acres of improved real property (Tax Map Parcel # 86.72-01-07.000). The property contains a house and a garage, directly adjacent to land currently owned by the College, situated at the Broadway Ave. – Pashley Drive entrance to the college. The property was acquired by the Auxiliary Services Corporation In May 2011. The College will use campus reserves to pay for the acquisition of the property. The College intends to use the acquired property as office space for its Department of Facilities and Construction. Attachment DESCRIPTION Conveys: ALL THAT TRACT OR PARCEL OF LAND situate in the City of Cortland, County of Cortland and State of New York, bounded and described as follows: BEGINNING at a point marked by a found iron rod in the west edge of the west walk of Broadway, said point being located northwesterly, as measured along said west edge of the west walk of Broadway, a distance of 379. 13 feet from its intersection with the north edge of the north walk of Warren Steel; running thence S 86° 47' SO" W a distance of 148.40 feet to a point marked by a found iron pipe; running thence N 32° 02' 40" W a distance oŁ 53.41 feet to a point marked by a found iron pipe; running thence N 57° 37' 20" E a distance of 130.0 feet to a point marked by a set iron rod in the aforementioned west edge of the west walk of Broadway; running thence S 32° 02' 40" E, along said west edge of the west walk of Broadway, a distance of 125.75 feet to the point and place of beginning, containing 0.27± acre of land. There is also conveyed herewith all the right, title and interest of the parties of the first part in and to the strip of land adjoining the above descried premises on the east, to the centerline of Broadway, subject to the rights of the public therein for street and highway purposes. The above described premises are more particularly shown on a survey map entitled "Map Showing Lands or Peter D. & Joanne P. Lalla", dated March 1, 2005, made by Denkenberger & Greene, Professional Land Surveyors, annexed hereto and incorporated herein by reference. Being the same premises conveyed by John C.
