Zimpher, Chancellor SUBJECT: Acquisition of Property - State University of New York, College of Veterinary Medicine I recommend that the Board of Trustees adopt the following resolution: Whereas Education Law �5716 authorizes Cornell University to convey land to the State of New York, without consideration, upon which the State may erect buildings, owned by the State, for the purposes of the State University�s statutory colleges at Cornell; and Whereas Cornell University proposes to convey to the State, without consideration and pursuant to an agreement required by Education Law �5716 (�Agreement�), approximately 8.05 acres located in the Town of Ithaca, County of Tompkins, the approximate location of which in indicated in the map attached hereto, for the purpose of the construction of a Teaching Dairy Barn for the College of Veterinary Medicine; now, therefore, be it Resolved that the Chancellor, or designee, be, and hereby is, authorized to execute the Agreement and any and all other documents, notices, maps, or any other instruments necessary or appropriate to effect the acquisition of title to and possession of such property. Background The resolution authorizes the Chancellor, or designee, to effect transfer of title from Cornell University to the State of approximately 8.05 acres to support construction of a State-owned facility for one of the State University�s statutory colleges at Cornell, the College of Veterinary Medicine. Ch. 53 L. 2008 appropriates $7 million for the construction of a Teaching Dairy Barn at the State University�s College of Veterinary Medicine. Education Law �5716 authorizes Cornell University to convey real property to the State, without consideration, pursuant to an agreement between Cornell University and SUNY, for the statutory colleges. Pursuant to the enabling legislation for each of statutory colleges, buildings furnished by the State become property of the State, and Cornell University has custody and control of such buildings.
